Terms of Use

1. Agreement

These Terms of Use ("Terms") govern your use of the My Metabolism iOS application and related website at mymetabolism.org (collectively, the "Service"), operated by My Metabolism ("we," "us," or "our"). By downloading, accessing, or using the Service, you agree to these Terms and our Privacy Policy.

The app is also subject to Apple's standard Licensed Application End User License Agreement ("Apple Standard EULA") for apps distributed through the App Store. If there is a conflict between these Terms and the Apple Standard EULA regarding App Store distribution, the Apple Standard EULA controls for that subject matter. See Apple's Standard EULA.

2. Wellness-Only Service

My Metabolism provides wellness metabolism trend estimates, food logging tools, optional sync features, and educational coaching information. The Service is for educational and wellness tracking only. It is not medical advice and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

AI nutrition estimates, metabolism score estimates, heart-rate and temperature trend views, and coaching content are estimates and examples only. Individual results vary. No specific weight loss, health improvement, metabolism change, calorie accuracy, or coaching outcome is guaranteed. Confirm important health decisions with a qualified professional.

3. Subscriptions & Free Trial

Premium features may require a paid auto-renewable subscription processed through Apple's App Store. When offered, subscriptions may include a 3-day free trial. After the trial, your subscription converts to a paid plan at the price shown in the App Store at the time of purchase unless you cancel before the trial ends.

• Billing: Payment is charged to your Apple ID account.
• Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Manage or cancel: You can manage or cancel subscriptions anytime in Settings → Apple ID → Subscriptions on your iPhone.
• Trial forfeiture: Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable under Apple's rules.
• Refunds: Refunds are handled by Apple, not by us directly.
• Verification: Subscription status may be verified through RevenueCat.

Prices, trial availability, and plan features may change. The price and terms presented in the App Store at purchase apply to your transaction.

4. Optional Features

Optional features — including Apple Health sync, Fitbit/Google Health sync, AI food analysis, optional location context, and coaching signup — are offered at your choice. Their data practices are described in our Privacy Policy.

Food photos, descriptions, and optional location may be processed by cloud AI services to generate estimates. Coaching applications may be stored server-side for follow-up. These features remain optional.

5. Acceptable Use

You agree not to misuse the Service, attempt unauthorized access to our systems, interfere with other users, or use the Service in violation of applicable law. You are responsible for information you submit through coaching forms or food analysis features.

6. Intellectual Property

The Service, including its design, text, graphics, and software, is owned by us or our licensors and is protected by applicable intellectual property laws. You receive a limited, non-transferable license to use the app as permitted by these Terms and the Apple Standard EULA.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted operation, error-free AI estimates, accurate calorie or macro calculations, successful sync with third-party services, or any particular wellness result.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR ONE U.S. DOLLAR IF YOU HAVE NOT PAID US.

9. Changes

We may update these Terms from time to time. If we make material changes, we will update the effective date above. Continued use of the Service after changes constitutes acceptance of the updated Terms.
